Maybe Mycroft somehow knew that they had been arrested? He is the British Government, after all!

I think Mycroft knew from Lestrade or/and the way he usually knows about Sherlock's cases - remember how he had glanced over the police report in ASIB?
He knew Sherlock was on the run but had to stay out of it so he could deal with it on his own.
